Terms and conditions

Last updated: 24 October 2026

1. Who we are and acceptance of the terms

RoFish (the mobile app and the website https://rofish.app) is operated by COLAC ION-VALERIU PERSOANĂ FIZICĂ AUTORIZATĂ (sole trader), tax ID (CUI) 54290566, Trade Register no. F2026014810004, registered office at B-dul Bucureștii Noi nr. 136, parter, ap. 5, Sector 1, Bucharest, Romania, contact: admin@rofish.app, phone +40 768 985 698 (“RoFish”, “we”). By creating an account or by using the app or the website, you enter into a contract with us under the conditions below. If you don't agree with them, please don't use RoFish. These terms are supplemented by the Privacy policy. When you create an account we ask you to explicitly confirm that you have read and accept these terms and the Privacy policy; we record the date and the accepted version in your account. If you sign up through Google, Facebook or Apple, acceptance happens by continuing the login process after this notice is shown. This English version is a translation provided for convenience; the Romanian version of these terms is the legally binding one.

2. What RoFish is

RoFish is a platform for anglers in Romania that offers: • a directory of fishing spots (lakes, rivers, reservoirs) with information, photos, reviews and a map; • a social network: catch posts, comments, likes, polls, private messages and a general chat; • useful tools: weather, solunar, water levels, fish identification using artificial intelligence, a beginner's guide, calculators; • Marketplace: buy-and-sell listings for fishing gear between users; • for some lakes, online booking and payment; • voluntary donations, through which you support the project (section 10). The basic service is free. We reserve the right to modify, suspend or discontinue any of the features. RoFish's role in payments: in the Marketplace, RoFish is only a technical intermediary between seller and buyer: sales are paid only by card (the “Buy” button), and the payment goes directly to the seller's Stripe account, and RoFish only keeps the intermediation fee, for which it issues an invoice to the seller (section 8); for online bookings, RoFish is an intermediary between the angler and the owner of the fishery, who provides the fishing service (section 9); donations are voluntary contributions (section 10). All card payments are processed by Stripe (Stripe Payments Europe, Ltd.).

3. Minimum age and your account

You can create and use an account only if you are at least 18 years old (some features, such as identifying a fish from a photo, use services that do not allow users under 18). You are responsible for keeping your login details safe and for all activity in your account. Your profile details must be real and not misleading (don't pretend to be another person, an institution or a lake owner). One account per person. You can delete your account at any time from Settings → My account → Delete account.

4. Rules of conduct

You may not use RoFish to: • post content that is illegal, defamatory, obscene, violent, discriminatory or that harasses, threatens or intimidates other people; • publish other people's personal data (phone number, address, photos) without their consent; • infringe copyright, trademarks or other third-party rights; • send spam, unsolicited advertising, pyramid schemes or dangerous links; • promote poaching, fishing with gear or methods forbidden by law, or other illegal acts; • access systems without authorisation, extract data automatically (scraping), bypass technical limits or disrupt the service. You can block other users and report content or behaviour from the app (Settings → Report a problem, or from the menu of a post/listing). Breaking the rules can lead to content being removed, your account being suspended or closed and, in serious cases, the authorities being notified.

5. Content posted by users

You remain the owner of the photos, clips, texts, reviews, polls and listings you publish. By publishing, you grant us a non-exclusive, free, worldwide licence to store, reproduce, technically adapt (e.g. resize), display and distribute this content within RoFish and in promotional materials for the platform (e.g. RoFish's social media pages), crediting the author where reasonable. The licence ends when you delete the content or your account, except for copies already included in previously published promotional materials and backup copies kept for a limited time. You guarantee that you have the right to publish the content and that the people appearing in photos have given their consent. Public content (profile, posts, reviews, comments, general chat, listings) is visible to anyone using RoFish and may be indexed by web search engines. We don't check content in advance, but we may remove it without notice if it breaks these terms or the law. If you believe some content is illegal or infringes your rights, write to us at admin@rofish.app with the link to the content and the reason; we review reports within a reasonable time and tell you our decision (in line with EU Regulation 2022/2065 on digital services). Map pins: on public waters you can drop pins with the exact spot, photos, comments and directions. You choose who sees them: everyone, only your followers or only you. Don't post pins that encourage fishing in forbidden areas or periods or that reveal other people's personal data. The RoFish team may hide a pin that breaks the rules and may mark a spot as “fishing forbidden”.

6. Information about fishing spots and fishing legislation

Information about fishing spots (facilities, prices, opening hours, rules, species, contact details, map location) comes from public sources, users and owners. We do not guarantee that it is 100% correct or up to date: it may be incomplete or unconfirmed, and it can change at any time without notice. Before you set off, call the owner or manager of the spot and confirm directly with them the information that matters to you (whether it is open, the price, the rules, the booking). RoFish is not liable for wasted trips, costs or inconvenience caused by unverified information. Information about closed seasons, minimum sizes, protected species, permits and authorisations is for guidance only. Complying with fishing legislation (in particular Fishing Law no. 176/2024 and the orders of ANADSPA, formerly ANPA) is solely your responsibility. You fish at your own risk; RoFish is not liable for accidents, fines or damage occurring at fishing spots. The weather forecast, the solunar calendar and the water levels are guidance information taken from third parties (Open-Meteo and the data published by INHGA, respectively) and may be delayed or inaccurate; if the source is unavailable we show the last saved values, with their date. Don't rely on them alone for your safety on the water.

7. Reviews

Reviews must reflect your own real experience at that spot. Fake reviews, paid reviews, reviews written by an owner for their own lake or against competitors, and review blackmail are forbidden. We may remove reviews that break these rules. We don't guarantee that every review comes from a verified visitor. For some spots, the rating and number of reviews shown combine the reviews from RoFish with the public rating from Google, while the share of Facebook recommendations is shown separately. We collect these figures periodically from the public pages; they don't come from RoFish users and may not be up to date.

8. Marketplace (listings between users)

The RoFish Marketplace is a listings space where users buy and sell fishing gear and related items directly with each other (rods, reels, baits, clothing, boats, accessories etc.). RoFish is only a technical intermediary: we are not a party to the transaction, we don't own, check or deliver the goods, we don't collect the price ourselves (the payment is made through Stripe, directly into the seller's account) and we give no guarantees for the goods. The sales contract is concluded solely between the seller and the buyer. The seller's obligations: • to be the legal owner of the item and have the right to sell it; • to describe the item correctly and completely (new/used condition, defects, what's included) and to show the final price, in RON; • to publish a single listing for the same item and withdraw it if the item is no longer available (after the card payment the listing is automatically marked as sold and can no longer be edited); • not to publish: weapons of any kind (including bladed weapons, hunting knives and other hunting items; fillet knives and ordinary fishing tools are allowed), ammunition, pyrotechnics, fishing gear or substances forbidden by law (monofilament nets, electrical devices, poisons, explosives), live fish or animals, products from protected species, stolen or counterfeit goods, or any other goods whose sale is forbidden or restricted by law; • to comply with the tax obligations on the income obtained. Professional sellers (companies, sole traders or people who sell regularly for commercial purposes) must identify themselves as such in the listing and comply with consumer protection law, including GEO 34/2014 (pre-contractual information, the 14-day right of withdrawal for distance sales) and warranty obligations. For occasional sales between individuals, the right of withdrawal under GEO 34/2014 does not apply. Advice for buyers: pay only with the “Buy” button in the listing, don't pay the seller outside RoFish (cash, bank transfer, advance payment) and don't share card details in messages. Conversations about listings (questions about the item, delivery) take place through the app's messages; RoFish may look at these conversations only following a report or a legal request. Card payment through RoFish and the fee. Publishing listings is free. Marketplace items are paid only by card, through RoFish: the seller does not ask for or accept payment outside RoFish for items in listings. Before the first listing, the seller enables card payment once: they create their Stripe account connected to RoFish (Stripe Payments Europe, Ltd.), accept the Stripe terms and pass the verification required by Stripe. By publishing a listing, the seller accepts these terms, including the fee and the card fee below. The buyer pays by card, using the “Buy” button, in the secure Stripe form in the app or, on the website, on the secure Stripe page; the money goes directly to the seller's Stripe account, and the listing is marked as sold once the payment is confirmed. For each sale, RoFish automatically keeps, through Stripe, an intermediation fee of 1% of the item price, owed by the seller; the card processing fee charged by Stripe is also deducted from the seller's amount. The total to pay is shown to the buyer before payment. RoFish issues the invoice for the fee to the seller. When enabling card payment, the seller gives express consent for the service to be provided immediately on each sale and acknowledges that, once it has been provided, they lose the legal right of withdrawal (GEO 34/2014). If the seller refunds the buyer in full, the fee is automatically returned to them, through Stripe; the card fee is not returned by Stripe. Card details are entered only in the Stripe form -- we do not see or store them. RoFish is not a party to the sales contract and does not guarantee the item: delivery, returns and refunds of the price (made by the seller) are agreed between seller and buyer. Delivery and billing details. When they tap “Buy”, before paying, the buyer fills in the details needed for delivery: the delivery method (by courier or in-person handover), the recipient's name, the phone number, the delivery address (for courier delivery), any notes for the seller and the billing details (optionally, the company name and tax ID (CUI)). The buyer is responsible for their accuracy. The seller receives these details only after the payment is confirmed, in “My transactions”, and may use them only to ship or hand over the item, for the invoice and for communication about this sale: the seller does not pass them on to anyone else (other than the courier company delivering the item), does not use them for other purposes, such as advertising, and does not keep them longer than necessary. Any disputes about the goods are settled directly between the seller and the buyer. We may delete any listing that breaks the rules or the law (including listings that ask for payment outside RoFish) and may suspend accounts that abuse the Marketplace. While an account is suspended, its listings are not shown and cannot be bought; after a temporary suspension they reappear automatically. Refunds for a sale paid by card are only made in full, never partially. After a refund, the item does not automatically return to the listing's stock.

9. Online bookings and payments at lakes

For lakes with online booking enabled, payment is made through Stripe (Stripe Payments Europe, Ltd.). RoFish acts as an intermediary between you and the lake owner: the owner provides the fishing access service, and RoFish keeps an intermediation fee of 10% of the lake's price (the rate for the chosen duration plus the companion fee), of which 5% is given to you as a discount for booking online. In practice, you pay 95% of the lake's price and the owner receives 90%. The payment processing fee charged by Stripe is covered by RoFish out of its fee, up to the amount of that fee: for very small amounts, the part of the processing fee that exceeds the RoFish fee is borne by the owner. The lake's price, the discount and the total to pay are shown to you before payment. A booking request is confirmed only if the owner accepts it within the time shown in the app; if they reject it or don't respond, you get a full refund. Cancellation and refund conditions after confirmation are set by each owner and shown on the lake's page. Because the booking concerns a leisure activity on a specific date, the 14-day right of withdrawal under GEO 34/2014 does not apply (art. 16 letter l). Tax documents for the fishing service are issued by the owner; for the RoFish fee, by RoFish. The owner can accept a request no later than the day of the visit; after that date the request can no longer be accepted and the amount held on your card is not charged. A paid booking cannot be cancelled or deleted in the app: for a cancellation or refund, contact the lake owner or write to us at admin@rofish.app. If the owner refunds your money after accepting the booking, the booking no longer remains confirmed and RoFish keeps no fee for it: the fee is returned to the owner (for a partial refund, in proportion to the amount refunded). The payment processing fee is not returned by Stripe on a refund and remains with the owner. You can see the status of your bookings in your account, under “My bookings”.

10. Donations

You can support the development and upkeep of RoFish with a voluntary donation, one-off or monthly, on the RoFish website, in the “Donate” section (the mobile apps do not accept donations). Payment is made by card, through Stripe (Stripe Payments Europe, Ltd.), on the secure Stripe page; we do not see or store card details. A donation is not payment for a service and gives you no rights or benefits in the app; if you choose, an announcement appears on the RoFish feed that you supported the project. Donations are non-refundable, except for obvious errors (for example a wrong amount) reported within 14 days at admin@rofish.app. A monthly donation can be cancelled at any time from the confirmation email received from Stripe or by writing to us.

11. Fish identification and other artificial intelligence features

The “Identify the fish” feature and the length and weight estimate from a photo send the photo you choose to a third-party artificial intelligence service, Google Gemini (Google LLC), which processes it under its own terms and returns an estimate (the species, with a confidence level, or the size of the fish). Before the first photo is sent, the app tells you this and asks for your consent; if you do not agree, do not use these features -- the rest of the app works without them. We do not keep the photo, only the result. The result is indicative and may be wrong; do not use it as a basis for decisions with legal consequences (protected species, minimum sizes, closed seasons). The number of identifications and estimates is limited per day. Do not send photos showing people or other people's personal data.

12. Lake owners

An account is linked to a lake manually, after verification by the RoFish team. The owner is responsible for the accuracy of the information they publish (prices, rules, opening hours, contact) and for the services provided to anglers. Users can propose corrections to a lake's information; proposals are shown only after approval by the RoFish team. To receive online bookings, the owner creates a Stripe account connected to RoFish (Stripe Connect), accepts Stripe's terms and passes the identity verification required by Stripe; payments are transferred by Stripe. For each online booking, the owner receives 90% of the lake's price: RoFish keeps 10%, of which 5% is given to the angler as a discount, and covers the Stripe processing fee out of its fee, up to the amount of that fee (for very small amounts, the difference is borne by the owner). If the owner refunds the angler, RoFish returns its fee to the owner (in full or in proportion to the amount refunded), but the Stripe fee for the payment is not refunded. The owner is solely responsible for declaring income, issuing tax documents to anglers and meeting the legal obligations of their business (permits, consumer protection, site safety).

13. Partners and commercial content

The “Partners” section and other materials presenting shops, manufacturers or services are shown for information and, where applicable, based on partnerships. They are marked as such and are not a recommendation or guarantee from RoFish for those products or services; the contractual relationship is established directly between you and the partner. Any commercial communication in RoFish is identifiable as such, in line with Law 365/2002. We don't show personalised ads based on your data.

14. Intellectual property

The RoFish name, logo, design, code, the texts we write and the fishing spot database (also protected by the sui generis database right, Law 8/1996) belong to us. You may use RoFish only for personal, non-commercial purposes. Systematic extraction or reuse of the data without our written consent is forbidden.

15. Suspension and termination

We may suspend or close your account if you break these terms, the law or the rights of others, or if the use of your account poses risks to the platform or other users. Where possible, we'll inform you in advance and explain the reason; you can challenge the decision by writing to us. You can end your relationship with us at any time by deleting your account. While your account is suspended you cannot post, comment or send messages, and your Marketplace listings are not shown. To prevent abuse, some actions (for example reports, photos sent for lakes, water-level alerts, blocks and pins) have an hourly or daily limit.

16. Limitation of liability

RoFish is provided “as is”, without guarantees of uninterrupted availability or of the accuracy of the information. To the extent permitted by law, we are not liable for: damage resulting from inaccurate information about fishing spots or weather/hydrological conditions; transactions, goods or behaviour of other users (including in the Marketplace); data loss or interruptions caused by third-party providers; the use of the results of artificial intelligence features. Nothing in these terms limits our liability for fraud, gross negligence or personal injury, or affects your statutory consumer rights.

17. Changes to the terms

We may update these terms. For important changes we'll notify you in the app or by e-mail at least 15 days before they take effect; if you don't agree, you can delete your account before that date. Continuing to use RoFish after they take effect means you accept the new terms. The date of the last update is shown at the top.

18. Applicable law and dispute resolution

These terms are governed by Romanian law. We try to settle any disagreement amicably -- write to us first at admin@rofish.app. If you are a consumer, you can also contact the National Authority for Consumer Protection (anpc.ro), including through its alternative dispute resolution platform (reclamatiisal.anpc.ro). Disputes not settled amicably fall under the jurisdiction of the Romanian courts.

19. Distribution through the App Store and Google Play

The mobile app is distributed through the App Store (Apple) and Google Play (Google). These terms are concluded between you and RoFish, not with Apple or Google, who are not parties and have no obligation of maintenance, support, warranty or compensation related to the app; any claim (including about conformity, intellectual property or product liability) must be addressed to us. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You must also comply with the terms of the store you installed the app from. You declare that you are not located in a country subject to a US government embargo and are not on a list of restricted persons.

20. Final provisions

These terms, together with the Privacy policy and the conditions shown on a lake's page when booking, form the entire agreement between you and RoFish. If a clause is declared void, the others remain in force. Not enforcing a clause immediately doesn't mean we waive it. You may not assign your rights under this contract without our consent; we may transfer the contract to an entity that takes over RoFish, informing you. We are not liable for non-performance caused by force majeure (provider outages, disasters, measures by the authorities). The language of the contract is Romanian.

21. Contact

For any question about these terms: admin@rofish.app, or the “Report a problem” option in Settings (in the app).
